Photo licence

Every photograph published on Kshevchenko (kshevchenko.art) is a work protected by the Polish Act of 4 February 1994 on Copyright and Related Rights. This page explains how the photos may be used and how to obtain a licence.

1. Author and rights holder

The photos are made by, and all economic copyright belongs to, Kateryna Shevchenko, Zawiszy Czarnego 6, 40-872 Katowice, Polska, tax ID (NIP): 6343060594.

All rights reserved. Publishing a photo on this site does not grant any licence to use it.

2. What you may do without a licence

  • view the photos on this site and share a link to the site or to a particular gallery;
  • use them within the statutory exceptions of Polish copyright law (Articles 23–35 — e.g. private use, quotation), crediting the author as "photo: Kateryna Shevchenko / kshevchenko.art".

3. What requires a licence

Without the author's written permission (a licence) you may not, in particular:

  • copy or publish the photos on other websites, social media, portals or listing services;
  • use the photos in advertising, promotional materials, packaging or print;
  • edit the photos, crop them in a way that changes their meaning, or remove authorship marks and metadata;
  • use the photos to train artificial intelligence systems or for text and data mining — the author expressly reserves this use (Article 26³ of the Copyright Act).

4. How to obtain a licence

Licences are granted individually, in writing or electronically. Write to k.shevchenko.gallery@gmail.com and include:

  1. a link to the photo (or gallery) you are asking about;
  2. how and where it will be used (e.g. website, print, advertising);
  3. the period and territory of use;
  4. the details of the person or company that will hold the licence.

You will receive the terms and a quote within a few business days. A licence covers only the uses stated in the agreement.

5. People shown in the photos

A copyright licence does not include consent to publish the image of the people shown (Article 81 of the Copyright Act). If a photo shows an identifiable person, their consent is required in addition to the licence — we can help obtain it or suggest another photo.

6. Photos from your own session

Clients who received photos from their session may use them privately — print them, put them in albums and on their personal social media profiles. Crediting the author is appreciated. Commercial use (e.g. advertising your own business) requires a separate licence unless the session agreement states otherwise.

7. Infringements

Using the photos without a licence infringes the author's economic and moral rights and may give rise to claims under Articles 78 and 79 of the Copyright Act. Please report any unauthorised use to k.shevchenko.gallery@gmail.com.

Matters not covered by this document are governed by Polish law.
